What is Visa?

                : Visa is the document to allowing foreigners to enter Thailand. You need to apply for Visa from Thai Embassy or consulate and you will get a stamp or sticker on your passport. However, some countries entering to Thailand need no Visa.




How many types of Visa and what are they?


                : There are many types of Visa, but we will explain to you only the important one as followed


1.       Non-Immigrant Visa


The alien files an application at Thai Embassy or Thai consulate abroad and need to show the evidence as well as reasons in applying for this Visa stating the purpose of visiting Thailand. This type of Visa is very special because it is the only type of Visa that can apply for Work Permit and can stay in Thailand as long as needed.
Warning: Normally, the Visa stamp will specify Visa type with Visa code and showing the Visa time valid from the issuing date.
However, this time frame caused a lot of misunderstanding and they think that it is the time allowing to stay in Thailand. In fact it is not because the time specify in Visa is the only time for using that Visa to travel to Thailand if you enter Thailand during that specific time you will get only 90 days Visa to stay in the country even though you travel to Thailand on the last day of that Visa date.



2.       Tourist Visa


This type of Visa is for tourist. It has to be filed at the Thai Embassy or Thai consulate abroad same as the Non-immigrant Visa. However, when entering Thailand with this type of Visa you will be allowed to stay in Thailand for “60 days” and you can extend your stay by applying for 30 days more (except Sri Lanka, Bangladesh, India, Pakistan, Nepal, Iran, Nigeria, Togo, Uganda can apply for only 7 days according to the policy of the immigration office)

Warning: Tourist Visa cannot apply for Work Permit and cannot stay in Thailand for a long time. If you would like to change Visa type to be a “Non-Immigrant Visa” you can do it at the immigration office.


3.       Transit Visa

The process of applying for this Visa is the same as applying for Tourist Visa but the different is the length of the time allowed to stay in Thailand. When travelling by Transit Visa to Thailand, you will be allowed to stay only “30 days” and can extend for another 30 days (except Sri Lanka, Bangladesh, India, Pakistan, Nepal, Iran, Nigeria, Togo, Uganda can extend only 7 days according to the policy of immigration office)
                Warning: This type of Visa cannot apply for Work Permit and cannot stay in Thailand for a long period of time. If you would like to change Visa type, you do so by applying for Non-Immigrant Visa  at the immigration office.


4.       Visa On Arrival

This Visa will be stamped at the immigration. It is one type of Tourist Visa to facilitate those foreigners who want to travel to Thailand but not convenience to apply for Tourist Visa at the Thai Embassy or Thai consulate abroad.



Warning:
-          Not every country that can get this Visa on Arrival. It must be the countries that specify in the list. Also the length of time allowed to stay is different for each country and depend on each the immigration office.
-          List of the countries that can get Visa on Arrival.

However, if the applicant is only the alien or stateless that hold passport for alien (Not passport) of that country, cannot apply for Visa on Arrival but need to get Visa from Thai Embassy or Thai consulate abroad before travelling to Thailand.
 
The Visa on Arrival cannot apply for extending period to stay in Thailand except in case of getting sick or accident by applying at Immigration office and the officer will consider the request case by case.
 
Which countries can travel to Thailand without Visa?
                : The citizen of the following countries can travel to Thailand without Visa and can stay in Thailand not more than 30 days as tourists.

The alien that does not hold the citizenship of that country (no passport) or the stateless people that hold the travel documents for alien issued by 45 countries/ economic area will not be Visa excepted and still need to ask for Visa from the Thai Embassy / Thai consulate abroad before travelling to Thailand.
                The alien who travel to Thailand will get excepted for travel Visa according to the announcement of the Ministry of Interior. The alien can stay in Thailand not more than 30 days each time an can get extension without any limit except entering Thailand through the immigration office at the border (by land) will be allowed to stay for only 15 days each time (except Malaysian who travel through Thai-Malaysia border will be allowed to stay for not more that 30 days each time)
                Thailand has the agreement with the following countries for the Visa exempted for the one who hold the ambassador passport or government passport can stay in Thailand for 90 days.

What is the qualification of the Visa applicant?


                : The general qualifications of the applicant for Visa to Thailand are as followed:
1.       Hold the passport or travel document that has the validity of not less than 6 months.
2.       Showing the documents that prove to be left Thailand after the allowed period for example Air Ticket and Visa or documents stating that they can go back to their country or going out to the other country (in case of transit)
3.       Not a restricted person according to the Immigration Law BE.0522 or being sentenced by Thai Court or other countries Court or having the evidence that may be dangerous to the country or may be the terrorists or the person that most wanted by the government of the other countries.
4.       Evidence showing enough money for the expense during the stay in Thailand that is 10,000 Baht/person or not less than 20,000 Baht/family by showing the amount of money to the officer.
What is the meaning of each code that appeared on the Visa?
       
:  The code that appeared on the Visa has the following meanings:

1.       D = Diplomatic
2.       F = Official
3.       TR = Tourist
4.       S = Sport
5.       B = Business
6.       IM = Investment through Ministry
7.       IB = Investment through BOI- Board of investment
8.       TS = Transit
9.       C = Captain or Crew
10.    ED = Education
11.    M = Mas Mediaor Communication
12.   R = Religion
13.   RS = Research and Science
14.   EX = Expert
15.   O = Others
16.   OA or end up with “A” will be allowed for 1 year Visa at the immigration office on arrival.
What is the process and conditions of applying for Visa?
        :  The detail of each type of Visa is different.  Here we will talk only the list of documents and the important condition. We will not go into small details since each case may have different  detail for each specific case you can contact us at the email and telephone number given at the preface of this book.
       
Term and condition for applying each types of Visa are as followed:

1.       Business Purpose: for example Working for the company  will get 1 year Visa each time.

1.1   Alien need to apply for Non-Immigrant Visa.
1.2   The company or business must be registered and have the control of not less than 2 million baht for hiring 1 foreigner.
1.3   Business must have the ratio of 1 foreigner/4 Thai Staff.
1.4   Must have Work Permit

2.       In case of working in the Government Office, Government Organization / Public Sector and others can apply for Visa 1 year each time.

2.1   Alien must get Non-Immigrant Visa
2.2   The documents certify by the Government Office, Government Organization and Public Sector, State Enterprise etc.
2.3   Must have Work permit

3.       Teacher or Instructor or Specialist in the Government Education Sector can get 1 year Visa each time.

3.2   Certify by that Education Sector
3.3   Need to have Work permit

4.       Teacher / Instructor or Specialist in the Private Education Sector can apply for 1 year Visa each time.

4.2   That Education Sector  must be certify by the Government office and
4.3   The alien must be certified by that institute.
4.4   Need to have Work Permit

5.       For staying at the Government Education Sector or School can apply for 1 year Visa each time.

5.1   Alien must get the Non-Immigrant Visa
5.2   Need to be certify and requested by that institute.

6.       For studying at the private Education Sector, can apply for 1 year Visa.

6.1   Alien must get the Non-Immigrant Visa
6.2   The Education Sector has been certify by Government Office.
6.3   The Education Sector certify that the alien has been studying there and the education sector need to send a request to the immigration office.
6.4   Need to be certified by the Government Office (except studying in International School and University)

7.       In case of Training or researcher in the university or research institute, can get not more than 1 year Visa each time.

7.1   Alien must get the non-immigration Visa.
7.2   Get certify and show the requested letter from the Dean of the University or Director of the research institute.
7.3   Confirmation letter from the relevant government agency is needed.

8.       In case of the alien family that get permission to say in the Kingdom temporary for studying (for father, mother, spouse, children, adoption or the children of the spouse) can get not more than 1 year each time.

8.1   Must have the Non-immigrant Visa
8.2   Show evidence of the relationship in the family eg. Father, mother, children etc.
8.3   In case of being parents or father or mother, the father and mother of the applicant must have funds deposit in the bank in Thailand not less than 50,000 baht for 3 months (that amount must be in the bank not less than 30 days)

9.       In case of journalist, can apply for 1 year Visa each time.

9.3   Have been requested by Public Relation Department of Thailand or Ministry of Foreign Affair

10.   In case of Buddhism and religion affair, can apply for 1 year Visa each time.

10.1       Must have Non-Immigrant Visa
10.2       Must be certified by Buddhism organization or Government Office or MahaChulalongkorn University or MahaMongkut RajVitayalai
10.3       Certified by the Chief of the temple that applicant is working for or studying at.

11.   For Missionary Purpose, can apply for 1 year Visa each time.

11.1       Must have Non-Immigrant Visa
11.2       Have been certify by Religious Department or Buddhism Office of Thailand.
11.3       Have been certify by Religion organization that the alien working for.

12.   For the singer, actor musician in the hotel – The company that is in entertainment business under the registered capital of not less than 20 million baht, can apply for Visa of not more than 120 days each time.

12.1            Must have the Non-Immigrant Visa
12.2            Must have Work Permit
12.3            Certified by the Hotel or Entertainment Business in Thailand which has the paid capital of not less than 20 million baht.

13.   For the family of Thai Nationality (Only father, mother, spouse, children, adoption etc.) will get less than 1 year each time.
Terms and conditions
13.1            Must have Non-immigrant Visa
13.2            The evidence showing the relationship eg. Birth Certificate and Marriage certificate.
13.3            In case of spouse, must have relationship both de jure and de facto
13.4            In case of adoption or child of spouse must not be married and need to stay together as part of the family and age not more than 20 years or in case father or mother, father and mother must have the age of 50  year up.
13.5            In case of marrying Thai girl must have the income whole year not less than 40,000 baht/month except that alien has the bank account in Thailand under his name and not less than 400,000 baht by showing 3 months statements.

14.   In case of alien family can stay in Thailand temporary of not less than 1 year each time.

14.1            Must have Non-immigrant Visa
14.2            The evidence showing relationship eg. Birth Certificate or Marriage Document.
14.3            In case of marriage must have relation both de jure and de facto
14.4            In case of children, adoption or children of spouse under your patronage must stay as part of that household and age not more than 20 years old.
14.5            In case of father or mother must be 50 years old up.

15.   In case alien working in the Non-Profit organization or foreign foundation association, Foreign Chamber of Commerce, or Thailand Industrial Council can apply for 1 year each time.
Terms and conditions
 
15.1            Must have the Non-immigrant Visa
15.2            Have Work Permit
15.3            Certify and requested few the authorize or the director of that organization and/or
15.4            Certify and requested from the chief of office at least C.10 or equal. (without certify by the Government Office can apply not more than 90 days each time)

16.   In case  of spending old age (retirement visa) can apply for 1 year each time.
Terms and conditions
16.1            Must have Non-immigrant Visa
16.2            Age 50 years old up.
16.3            Have the financial evidence of not less than 65,000 baht/month or have the bank account in Thailand for not less than 800,000 baht/month and show at least 3 months

17.   In case of visiting the spouse or visiting the children under Thai Nationality, can apply for not more than 60 days.

17.1          Must have evidence of relationship eg. Marriage or Birth Certificate.
17.2          In case of spouse, the relationship must be de jure and de facto.
Remarks: After visiting the spouse for 1 time when time period allowed finished you cannot apply Visa for this type again until you leave the Kingdom and come back again.

18.   In case of entering for the purpose of health or healing in hospital, can get not more than 90 days Visa.

18.1            Certified by the doctor of that specific hospital or Embassy or Consulate.
18.2            For the Care Taker apart from Parents, Spouse, Children, Adoption or the children of the spouse, is allowed only 1 person

19.   For going to the court case will be allowed not more than 90 days.

19.1            Showing the evidence concerning the court case eg. Certified Letter from the court

20.   In case of working for the Government Sector or international Organization can get not more than 90 days Visa.

20.1            Certified and requested from Government Sector or Police Office or Army or international Organization.
20.2            If needed to stay for longer than 90 days, has to send request letter direct to Chief Police to consider case by case.

21.  In case of emergency with the embassy or consulate certified, can get not more than 30 days each time except for job training can get 90 days.

22.   In case of Nationality proof, can get not more than 180 days Visa.

23.   In case of actors, singers, musician or staff in the team that enter the  Kingdom temporary can get not more than 90 days Visa.

23.1            Must have the Non-Immigrant Visa
23.2            Must have Work Permit
23.3            Certified letter from the business or organization concerned.

After getting the Visa, what should we do?
: Re-entry permited
If the aliens want to leave the Kingdom, they should apply for the Re-Entry Permitted every time before leaving the Kingdom so next time when they enter the Kingdom, they should apply for the Re-Entry Permitted every time before leaving the Kingdom so next time when they enter the Kingdom again, they can stay in the kingdom as long as their Visa time left. If they do not do this process, the latest Visa time allowed will not be valid.


There are 2 types of Re-Entry Permitted as followed:


1.       Single: can use only one time.
2.       Multiple: can use many times until that visa expired.
 
: Staying in the Kingdom longer than 90 days
                                1. If any aliens stay in the Kingdom longer than 90 days, they need to report their address in Thailand at the Immigration office every 90 days. They can go by themselves or authorized others to do for them. They can also inform their address via registered mail before or after 7 days.
                                2. This report of 90 days stay longer is not the request for staying permanently in Thailand. The aliens who want to stay longer need to inform their address to the immigration. If they fail to do so they need to go to immigration office themselves and pay the fine of 2,000 baht or the aliens who have been arrested by the police need to be fined of 5,000 baht.
                                3. If the aliens have left the Kingdom, when coming back just start counting 90 days again in all case.
If the aliens stay longer than the Visa period allowed, what will be happened?
                : If the aliens who get whatever types of Visa and when the time allowed is over, but they still stay in Thailand without applying for extending Visa or not leaving the country, they will be fined 500 baht/day but maximum total fine will not be more than 20,000 baht.
 
 

What is the meaning of “Work”?


: Work means working with your labor or your knowledge your idea without considering the amount of money received. So whatever types of work you need to apply for Work Permit before you can work in Thailand.
What is “Work Permit”?
: Work Permit is the document that allowed aliens who stay temporary in the Kingdom and want to work in Thailand.
If the alien start working without Work Permit, what will be happened?
                : Many aliens work in Thailand without work permit. They will not be able to be protected under Thai Labor Law, However, if they have been arrested because they do not have work permit, they will be fined and put in jail or they may be sent out of the Kingdom within 30 days.

Apart from Work Permit, are they any rules or regulation to be aware of?


1. Apart from having Work Permit, the alien still need to be careful on the following points.
2. Must work in the field that work permit is applied for. If you want to work in other field you need to report and get permission first.
3. Must work according to what the employer apply for you
4.The working place must be the same as stated in the application. If you want to change the working place, you need to get permission first.
5.If you work in different terms and conditions from the Work Permit, you will be fined for 20,000 baht.
How much salary or monthly income the alien need to have in order to apply for Work Permit?
               

: The income required will be classified by countries as a reference for applying for Visa as followed:


1.       European Countries, Australia, Japan, America and Canada (except Russia) the minimum income is 50,000/month.
2.       South Korea, Taiwan, Hong kong, Singapore the minimum income is 45,000 baht/month
3.       Countries in Asia (excluding Japan, South Korea, Taiwan, Hong Kong, Singapore, Myanmar, Laos, Vietnam, Cambodia) , Countries in South America Countries in East Europe, Countries in Central America,  Mexico, Russia and South Africa, the minimum salary is 35,000 baht/month.
4.       Countries in Africa (excluding South Africa), Myanmar, Laos, Vietnam, and Cambodia, the minimum income is 25,000 baht/month.
What kinds of work that are not allowed for the aliens by Thai law?
                : The following work is just for Thai citizen and not allowed for the aliens to work in these fields: (for detail information, please recheck again with the writer of this book)

If the Visa has already expired, can we still apply for the extension?
                : You can do so, but you need to pay the fine first.
 
 If the Work Permit expired, can we still apply for the extension?
                : That Work Permit will not be valid anymore since the date of expiration or the date of resignation. If you want to get new Work Permit, you need to pay the fine first.
What is Multiple Visa?
                : Multiple Visa is the visa that you can use to travel to Thailand more than one time for example: if you for Non-immigrant Visa from Thai embassy for 1 year , when you arrived Thailand you will get only 90 days Visa to stay in Thailand, but you can still use this Visa to ravel in and  out of Thailand till the Non-immigrant Visa expired and you will get 90 days Visa every time you travel to Thailand.
What is Single Visa?
                : Single Visa is the one time Visa for entering Thailand. Even though the Visa has not yet expired but you have left Thailand, the Visa will not be valid anymore. If you want to travel to Thailand again, you need to apply for new Visa.
If the aliens work with me without any Work Permit, as an employer do I have any responsibility on this matter?
                : As the employer of the alien who does not have Work Permit, you have to be fined at least 10,000 baht until 100,000 baht per alien who does not have work permit.
How to change your Visa to be Non-Immigrant Visa?
                : Use the same method as applying for Visa extension but the applicant for changing Visa to Non-Immigrant Visa need to have at least 15 days Visa first.
If the aliens get Visa when working in one place, can they move to the other office?
                : The aliens who want to change their working place need to inform or change Visa type before they can move to the new working place.
If the aliens leave or quite the company before time, can they stay in the Kingdom with the old Visa?
                : The alien cannot stay in the Kingdom with the old Visa if they quit the company before time including their family members and others who use their right.
Do the aliens need to go by themselves or can ask other person to act on their behalf when they apply for Visa?
                : The aliens need to go by themselves.
How many days in advance that the aliens need to apply for Visa extension?
                : 30 days before the Visa expired.
If the aliens lost their passport what should they do?
                : They need to report to the police, them contact the embassy of their countries to apply for new passport. Then bringing new passport with police records to immigration office to get Visa stamp in the new passport.
How much is the fee for Visa application and Work Permit?
                : 1. Visa fee

1.1 Visa Extension Fee = 1,900 Baht
1.2 Re-Entry Visa (Single) =1,000 Baht
1.3 Re-Entry Visa (Multiple) = 3,800 Baht

                  2. Work Permit Fee    
   

2.1  Application Fee = 100 Baht
2.2 Work Permit Fee (3 months) = 750 Baht
2.3 Work Permit Fee (6 months) = 1,500 Baht
2.4 Work Permit Fee (1 year) = 3,000 Baht
2.5 Work Permit (Adjustment) Fee = 1,000 Baht

                : 1. Changing Visa Type Form
1.1   For the alien who already has Tourist Visa and Transit Visa uses TM.86 Form
1.2   For the alien who does not have Visa or have the Visa on Arrival, uses TM.87 Form
2.For all Visa Extension uses TM.7 Form
3. For Re-Entry Visa uses TM.8 Form 
4. For staying in the Kingdom longer than 90 days uses TM.47 Form
